Terms of Use for Dew

1. Acceptance of terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Renat Norderhaug ("we", "us", "our", or "Developer") regarding your use of the Dew mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

2. Description of service

Dew is a mobile application that provides:

  • Alarms that require a typed positive affirmation to dismiss
  • A Reflect feed of saved affirmations
  • Customizable alarm wallpapers and sounds
  • Daily affirmation reminders
  • Premium features available through subscription

3. Eligibility

You must be at least 13 years old to use this App.

4. License grant and restrictions

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own, solely for personal, non-commercial use.

4.2 Restrictions

You agree NOT to:

  • Modify, reverse engineer, or decompile the App
  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Use automated scripts or bots
  • Interfere with the App's functionality
  • Sell, rent, or sublicense your rights to use the App

5. Premium subscriptions

5.1 Subscription terms

Certain features require a paid subscription ("Dew Pro"). Subscriptions are processed through Apple's App Store and subject to Apple's terms.

5.2 Payment

  • Subscriptions are charged to your Apple App Store account
  • Payment is charged upon confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • You can manage or cancel your subscription through your App Store account settings

5.3 Free trials

We may offer free trial periods. You will be charged once the trial ends unless you cancel before it expires.

5.4 Changes to pricing

We reserve the right to change subscription pricing. For existing subscribers, price changes will not apply to your current subscription period.

6. Intellectual property

The App and all its content, features, and functionality are owned by the Developer and protected by copyright, trademark, and other intellectual property laws. You retain full ownership of custom affirmations you create.

7. Medical disclaimer

7.1 Not medical advice

THE APP IS NOT INTENDED TO PROVIDE MEDICAL, MENTAL HEALTH, OR THERAPEUTIC ADVICE. The affirmations and content provided are for motivational purposes only and should not be considered a substitute for professional medical or mental health advice.

7.2 Emergency situations

If you are experiencing a mental health emergency, please contact:

  • 911 (emergency services)
  • 988 (Suicide & Crisis Lifeline)

The App is not designed for crisis intervention.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

9. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.

10. Third-party services

The App integrates with RevenueCat, Supabase, OpenAI (for Pro features), and Apple's App Store. Your use of these services is governed by their respective terms.

11. Modifications

We may modify these Terms at any time. Your continued use of the App after changes constitutes acceptance.

12. Termination

We may terminate your access at any time for any reason, including breach of these Terms. You may stop using the App by uninstalling it.

13. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.

14. Apple-specific terms

These Terms are between you and the Developer, not Apple. Apple has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these Terms.
